Humanitarian Parole

This process is linked to the request for a temporary stay permit that is given exclusively for humanitarian or urgent reasons, as well as for significant public benefit.

This permit was created with the objective of solving a crisis caused at the border due to the high demand for illegal crossings. In response to the above, the United States government has provided 30,000 monthly permits to be granted to citizens of Cuba, Venezuela, Nicaragua, and Haiti.

According to the Citizenship and Immigration Service (USCIS), it is necessary to start the process that the interested party have avalid passportIn addition to this, it is mandatory thathave a sponsor in the United States, who is willing to request the participation of the person in the humanitarian parole.

 
Beneficiaries must meet a series of conditions:

  • Your nationality of origin must be from the following nations: Nicaragua, Cuba, Venezuela or Haiti.

  • They must not be located in the United States.

  • They must have a valid and current passport to carry out international travel.

  • Have a sponsor with legal status who can offer support, both financial and of any kind.

  • The person must pay for their airfare to the United States.

  • Comply with vaccination requirements and other public health requirements established by the US Government.

  • People who have permanent residence or refugee status in another country or who have dual nationality.

  • Have been ordered removed from the United States within the previous five years or are subject to a bar of inadmissibility based on a prior removal order.

  • Have illegally crossed the borders of the United States, Mexico, or Panama after January 5, 2023.

The process

 

Step 1 - A support person who lives in the United States will file a Form I-134A. USCIS will then investigate the support person to ensure that they can support financially

Step 2: Submit Biographical Information

  • If USCIS confirms a support person, the listed beneficiary will receive an email from USCIS with instructions on how to create a myUSCIS account and next steps. The beneficiary will need to confirm their biographical information in myUSCIS and certify that they meet the eligibility requirements.

  • As part of their online account eligibility confirmation, individuals seeking authorization to travel to the United States will need to confirm that they meet public health requirements, including certain immunization requirements.

Step 3: Submit the Petition on the CBP One Mobile App

  • After confirming the biographical information in their online account and completing the required eligibility statements, the beneficiary will receive instructions through myUSCIS on how to access the CBP One Mobile App (PDF, 770.38 KB). The beneficiary will need to enter biographical information into CBP One and provide a photo.

 

Step 4: Advance Travel Authorization to the United States

  • After completing Step 3, the beneficiary will receive a notification in their online account confirming whether CBP will, at its discretion, provide them with advance authorization to travel to the United States to seek discretionary parole granted on a case-by-case basis.

  • If approved, this authorization is valid for 90 days. Advance travel authorization approval does not guarantee entry or parole upon arrival at a US port of entry (POE).

 

Step 5: Obtain Permit to Stay Temporary at the Port of Entry

  • When a beneficiary arrives at a port of entry, CBP will inspect them and consider them for discretionary parole on a case-by-case basis.

 

Step 6: Temporary Residence Permit

  • Those who are granted parole pursuant to this process will generally be paroleed into the United States for a period of up to two years, subject to health and investigation requirements, and will be eligible to apply for parole. employment authorization under existing regulations
