Petition for my parents

The IR-5 visa allows the parent or parents of a US citizen to legally live and work in the United States

​

This visa will need to be granted abroad and issued at the US embassy or consulate in the foreign country where the parents reside. You must also be at least 21 years old to sponsor the IR-5 visa for a parent.

​

Eligibility for the IR-5 visa

Eligibility for an IR-5 visa depends on the following factors:

  • The sponsorUS citizen Must be 21 years or older.

  • The sponsor must have the financial means to support the parents until they start working.

  • The sponsor must live in the United States and have a US address.

  • The sponsor must include a copy of their birth certificate to prove the relationship between the sponsor and the parents.

Step 1

Establishment of the parent-child relationship

All IR ("Immediate Relative") visa categories do not have annual limits , which means there's no waiting around for a green card to become available.

The first step in becoming a permanent resident of the US is for the sponsor to file theForm I-130 (officially called the "Petition for Alien Relative") to establish the parent-child relationship.

The process is a little different depending on where the father lives. If you are applying from outside the United States, your application will go through consular processing , which means it will be handled by your local embassy or consulate. If you apply within the United States, you will go through a process known as adjustment of status .

Step 2

Establishing Parental Eligibility for a Green Card

The US government follows two different processes to determine a parent's eligibility for a green card, depending on where the parent currently lives:

​

If the father is applying from outside the United States

After the sponsoring child has filed Form I-130, the US Citizenship and Immigration Services (USCIS) processes it. When the petition is granted, the father will be required to fill out Form DS-260 (Immigrant Visa Application) and provide proof that he is the father.

Once the DS-260 form is submitted, it is sent along with supporting evidence to the National Visa Center (NVC), which processes and reviews the visa application. The NVC may request additional evidence from the parents.

After the NVC processes the application, it will be sent to the embassy or consulate of the country where your parents reside.

If the parent is applying from within the United States

To apply for adjustment of status, the parent seeking a green card must have entered the United States with a valid visa or the Visa Waiver Program.

After the sponsoring child files Form I-130 and USCIS grants his petition, the parent will file Form I-485 (officially called the "Application for Adjustment of Status").

After receiving Form I-485, USCIS will mail a date, time, and place for the parent's fingerprints and eye scan (known as a biometric appointment).

Step 3

Attend the green card interview and wait for approval

The parent will be required to attend a interview at a US consulate or embassy if you are going through consular processing, and you may be required to attend an interview if you are using adjustment of status.

They must attend an interview in the city or country in which they live, and must bring:

  • Your USCIS appointment letter.

  • An unexpired passport valid for six months after the intended date of entry into the United States, if requested through consular processing

  • Two identical color photographs

  • English translations of documents that require translation

  • Supporting Documents: Original or certified copies of all civil documents the parent uploaded to the Consular Electronic Application Center (CEAC), if applying through consular processing

If the interview is successful, the visa will be granted and the father will be able to immigrate to the United States.

Once the father is in the United States, USCIS will mail his green card to his address in the United States.

​

  • A copy of your birth certificate

  • A copy of your passport (current)

  • A copy of your citizenship certificate

  • A copy of your Consular Report of Birth Abroad (CRBA)

  • A statement from a US consular officer that you have a valid passport and are, in fact, a US citizen

You will also need to establish your relationship with your parents.

​

  • A birth certificate, with your name and the names of your parents

  • A marriage certificate, with the names of both parents

  • Documents showing that previous marriages have ended

​

  • Two photos (passport size)

  • A copy of your birth certificates or, when that is not possible, other documents that prove your birth

  • An Affidavit of Support, showing that the applicant will receive financial support

​

Nationality Proof

  • Passport issued in another country

​

Proof of Entry and Legal Status

  • US visa

  • I-94 Trip Record

​

  • Judicial, police or prison records

  • deportation document

​

Supporting Documents for the DS-260 (Beneficiary outside the USA)

The beneficiary must present:

​

Nationality Proof

  • Birth certificate issued in another country

  • Passport issued in another country

  • Marriage certificate

​Proof of Military Service

  • DD-214 (if you served in the US military)

  • Other US military service records

  • Military service records from a country other than the United States

Supporting Documents for Financial Support (I-864)(Petitioner)

​

Proof of ability to financially support spouse 

​

  • Copy of your most recent US federal income tax return

 - Additionally, these documents can strengthen your application with:

  • Copies of your US federal income tax returns for the last 3 years

  • Pay stubs for the last 6 months

  • Letter from your employer to show proof of employment

  • Proof of ownership of stocks, bonds, certificates of deposit (CDs), or other investment account

  • Bank statements

​

 - If you use your home:

  • Ownership document (such as title or deed)

  • A recent appraisal by a licensed appraiser or a recent tax assessment

  • A document showing the amount of each loan secured by a mortgage, deed of trust, or other lien on the home

 

 - If you use your second vehicle:

  • Document of ownership (such as title or deed) for all vehicles, including the one you are listing as an asset

  • A recent appraisal by a licensed appraiser or a statement from the dealer indicating the current value of the vehicle.

  • Sponsoring spouse, financial co-sponsor (if applicable), and spouse seeking a green card

​

Proof of entry and legal status in the US

  • I-94 Trip Record

  • valid US visa

  • Passport issued in another country

​

Proof of pending marriage-based green card application

  • Notice of receipt ( Form I-797C) You need it if you are married to a Permanent Resident

​

Proof of prior authorization to work in the United States

​

proof of nationality

  • Birth certificate and photo ID

  • Visa issued by the consulate of a country other than the United States

  • Another national identity document with your photo and/or fingerprint

proof of identity

  • Two 2-inch by 2-inch passport photos 

​

Supporting Documents for Travel Permit (I-131) (Beneficiary)

​

Proof of identity (must show your name, date of birth and photo)

  • Green card

  • Passport (photo page only)

  • Current work permit, if available

  • Valid government issued driver's license

​

Proof of current immigration status

  • valid US visa

  • Any other document issued by the US Citizenship and Immigration Services (USCIS) that shows your current status, if any, in the United States (such as Form I-797 or "Notice of Action")

Proof of pending marriage-based green card application

  • Notice of Receipt (Form I-797 C)

Additional proof of identity

  • Two 2 x 2-inch passport photos
